Course Description

Health Care Fraud and Abuse has for years been identified as
one of the most important enforcement priorities of the Department of Justice. Cases
brought by the Department of Justice represent most of the largest fraud
settlements obtained by the federal government.  This class explores the
laws that form the basis for federal health care fraud and abuse enforcement,
including prohibitions on financial inducements, false claims and physician
self-referrals.  It also focuses on application of the false claims
provision to health care and the dynamics of cases brought by whistle-blowers,
including threshold defenses to false claims act cases.
