Course Description

Tort law focuses on compensation for injuries. Actors who cause injuries may have intended that harm, caused it negligently, or could be free from fault but still required to compensate the victim. The course aims to provide an analytic framework to assess the probability that particular conduct will result in the actor's liability. Of the topics, intentional torts receive the smallest attention. The primary focus is on strict liability for harms and negligence. We also will examine briefly the evolution of the common law system for imposing liability. This is one of the few opportunities students are likely to have to learn about the old "writ" system that is the basis for the common law.
