Course Description

The class is designed to explore the rationale courts have used to prevent case law advances from changing negligence into strict liability.  We will revisit Palsgraf and examine other early cases which limited negligence recovery. We will discuss important early articles. We will concentrate on Wisconsin cases, and the path the Wisconsin Supreme Court and various justices have taken in negligence methodology.  We will attempt to develop an analysis acceptable to a majority of the present court. Engaged discussion is required.
