Course Description


The course (which will meet once per week for two hours)
deals with the various aspects of construction law, drawing upon a student’s
existing knowledge of contract and tort law and expanding into the wide array
of construction specific issues --  such
as project delivery systems, risk allocation principles, contract forms,
insurance coverages, liens, surety bonds, owner and contractor claims and
dispute resolution processes.   The
sessions will be taught in a discussion and practical exercise format, focusing
on pre-assigned reading materials.  There
will be a final short answer essay or multiple-choice exam.  Over one-third of U.S. economic output is
related to the construction industry which produces a large volume of disputes
subject to resolution through ADR or judicial proceedings, requiring not only a
working knowledge of contract, tort, insurance and oftentimes surety law but
also industry standard project delivery systems and practices.  This course will meet once per week for two
hours focusing on the broad range of unique construction law issues from
contracting and risk allocation principles to claims resolution, drawing upon a
student’s existing knowledge of common law legal and equitable principles after
exploring the wide range of project delivery systems, procurement and
construction activities.  The sessions
will be taught in a class discussion and practical exercise format, focusing on
pre-assigned reading materials requiring approximately 50 pages of review for
each session.  There will be limited
lectures and grading will be based on class participation and a final short
answer essay or multiple-choice exam
