Event Description

The 2019 Wisconsin Law Review Symposium, “Rationing the Constitution: How Judicial Capacity Shapes Supreme Decision-Making,” will be chaired by Professor Andrew Coan, University of Arizona James E. Rogers College of Law, who is likewise a former University of Wisconsin Law School faculty member. The symposium will examine the theories that Coan puts forward in his recent book—namely, that institutional capacity limits serve to constrain judicial activism in many of the most important areas of constitutional law.

One of the themes of Professor Coan’s work, in his own words, is to “ground constitutional theory more firmly in the institutional and political realities of the American constitutional system. In this sense, it is—very self-consciously—part of the grand ‘law in action’ tradition of the University of Wisconsin.”
