Course Description

Development of the modern civil action including pleading, discovery, and the pretrial conference; the trial; motions after verdict and judgment; appeals; state and federal procedures.

Learning Outcomes:

-Students will be able to explain the various steps in the civil litigation process, from the filing of a complaint to a decision on appeal, and will be able to identify the procedural rules that govern at each step of the federal process.

-Students will be able to apply key rules in drafting various documents commonly used in civil litigation, including complaints and answers, discovery requests and responses, and summary judgment briefs.

-Students will be prepared to use practitioner tools (including leading civil procedure treatises and relevant case law) to identify appropriate motion practice strategies and develop effective factual and legal arguments to support or oppose procedural motions in civil litigation.
