Course Description

Constitutional Equality This seminar will focus on the Supreme Court's equality jurisprudence. in three areas of constitutional equality: gender, race, and sexual orientation. We will read the Court's most recent decisions in these areas in order to explore a number of questions: What constitutional standards has the Court (and the individual Justices) established in these three areas? What methodology does the Court (and individual Justices) employ in order to choose the constitutional standards? What values underly these methodological approaches? Does the Court (or individual Justices) employ a consistent approaches to equality issues? What issues are likely to arise in these areas in the near future? How will the Supreme Court (or the individual Justices) decide these issues?) How should the Supreme Court decide these issues?
