771 Marital Property - §003, Spring 2014

For Spring 2014, TNE-II has been split into two modules, for one credit each. Marital Property is one of those modules. (The other module is Estate and Gift Tax; students may enroll in either or both modules.)

The one credit Marital Property module will offer an overview, introducing the student to Wis. Stats. Chapter 766. The only prerequisite for the course is Trusts and Estates I (whether taken for two or three credits); no other exposure to marital property will be assumed.

Topics that will be covered include: classification of property under Chapter 766; management and control of marital property, access to and satisfaction of credit obligations; relationship between divorce law and marital property classification; spousal rights at death; marital property agreements; and ethical concerns regarding dual representation of spouses.

The Marital Property module will be offered during the second half of the semester, March 11 - April 29, on Tuesdays from 3:30 - 5:30 pm.

Students who have taken TNE-II are not eligible to take this course, since it covers the same material.
