Rights of Prisoners 5th (print and on Weslaw)

The Law of Probation and Parole 2d (print and on Westlaw)

WI DOC Division of Community Corrections Client Handook (online)

The first two of these titles in the Library's collection could potentially be used in conjunction with any of the Law School's many criminal law classes this Spring semester: 1) Rights of Prisoners 5th, and 2) The Law of Probation & Parole 2d.

Both titles were updated in 2024 and are available in print in the library's collection, and online via Westlaw.  The linked titles above will guide you to their print catalog records and call numbers.

Each of these multi-volume sets are described in further detail on their indvidual product pages provided by West publishing: 1) Rights of Prisoners 5th, and 2) The Law of Probation & Parole 2d.  The linked product pages include a "Quick Look Inside" section on the left-hand side with links to view their Table of Contents and Update Highlights.  I always encourage students to take a good look at the Table of Contents to see how a book is built and how it might best serve their needs.

Both of these titles have sections on the requirements due process imposes on the confinement of prisoners, and their eligibility for probation and parole.  The first and fourth amendments regarding speech and searches are also addressed.

The Rights of Prisoners 5th covers many other topics such as medical care, conditions of confinement, religious practices, access to the courts, and visitation in greater detail.

The Law of Probation and Parole 2d covers topics specific to the conditions of probation and parole such as cooperation with authorities, restrictions on movement, supervision, treatment and counseling, and payment of restitution.  Volume two of this title addresses all the many issues related to revocation including the general bases for revocation, evidentiary matters, and constiutional rights and guarantees.

Wisconsin practitioners may also want to familiarize themselves with a third title, the Wisconsin Department of Corrections' Division of Community Corrections Client Handbook.  The Client Handbook spells out the rules regarding probation and parole in Wisconsin, and may be helpful in assisting their clients' understanding of these matters.  The Client Handbook is available online in both English and Spanish.
