UW Law School Professor Anuj Desai will continue the tradition of the annual U.S. Supreme Court Update presentation to the Dane County Bar Association on Tuesday, September 11, 2007, at a noon luncheon at the Madison Hilton, Monona Terrace.

For many years, the late UW Law Professor Gordon Baldwin gave the presentation. Desai is dedicating his talk to the memory of his colleague, who died in October 2006.

Desai will discuss five cases from the Court’s 2006-07 Term:

Massachusetts v. Environmental Protection Agency (standing to sue the EPA and question of whether the Clean Air Act authorizes the EPA to regulate greenhouse gases from motor vehicles).

Gonzales v. Carhart (constitutionality of the federal Partial-Birth Abortion Ban Act of 2003)

Hein v. Freedom From Religion Foundation (standing to challenge President Bush's faith-based initiative as a violation of the Establishment Clause).

Federal Election Commission v. Wisconsin Right to Life (as-applied challenge to the constitutionality of the prohibition on corporate funding of broadcast advertisements that constitute "electioneering communication").

Leegin Creative Leather Products v. PSKS (antitrust case involving the question of whether the Sherman Act prohibits vertical minimum-resale-price agreements; that is, contracts between manufacturers and distributors that prevent the distributor from reselling the goods below a certain price).
